Overview

Welcome to The Deal Station. The terms “we,” “us,” and “our” refer to The Deal Station.

The Deal Station operates this store and website, including all related information, content, features, tools, products, and services offered to customers, collectively referred to as the “Services.” Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when accessing or using the Services.

Please read these Terms carefully. They contain important information regarding purchases, account use, warranty disclaimers, limitations of liability, and other legal rights.

By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not access or use the Services.

Section 1 — Access and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you are the age of majority and have authorized any minor dependents under your supervision to use the Services.

You may be asked to provide information such as your name, email address, billing information, payment details, and shipping address. You represent that all information you provide is accurate, current, complete, and that you have the right to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your customer account to another person.

We may suspend or restrict account access when reasonably necessary to protect customers, prevent fraud, comply with legal requirements, or enforce these Terms.

Section 2 — Products and Product Information

We make reasonable efforts to accurately display and describe our products. However, colors, dimensions, appearance, and other visual details may vary depending on your screen, device settings, manufacturing variations, or product updates.

Product photographs may include accessories, displays, backgrounds, or other items for illustration. Only the items specifically listed as included in the product description are included with your purchase.

We do not guarantee that the appearance, color, or presentation of a product will be identical to how it appears on your device.

Product descriptions, specifications, pricing, availability, and included components may be corrected or updated at any time. We may discontinue products or limit the quantities available to any customer, geographic area, or jurisdiction.

Some electronic products may require compatible phones, cases, applications, operating systems, networks, cables, chargers, or other equipment. Customers are responsible for reviewing compatibility information before purchasing.

Section 3 — Orders

Placing an order constitutes an offer to purchase. We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including because of:

  • Product unavailability
  • Pricing or description errors
  • Suspected fraud or unauthorized payment
  • Shipping restrictions
  • Quantity limitations
  • Compliance or safety concerns
  • Inability to verify customer or payment information

An order is not final until payment has been authorized and we confirm acceptance or begin processing the order.

Please review your products, quantities, colors, variants, address, and shipping method before submitting an order.

Cancellation requests must be submitted within one hour of purchase and before fulfillment begins or a shipping label is created. Once fulfillment has started or a shipping label has been created, cancellation may no longer be possible.

Returns, exchanges, and refunds are governed by our Return and Refund Policy.

Unless we expressly approve otherwise in writing, purchases are intended for lawful personal or household use and not for unauthorized commercial resale or export.

Section 4 — Prices, Payments, and Billing

Prices, promotions, discounts, and product availability may change without notice. The price charged will generally be the price displayed when the order is submitted, subject to correction of obvious pricing or listing errors.

Unless otherwise stated, displayed product prices do not include applicable taxes or shipping charges. Taxes and shipping charges are calculated during checkout when applicable.

You agree to provide complete and accurate billing, payment, shipping, and account information. You also agree to promptly update information that changes.

By submitting payment information, you represent that:

  • The payment information is accurate and complete.
  • You are authorized to use the selected payment method.
  • Charges incurred through the payment method will be honored.
  • You will pay all applicable product, shipping, and tax charges associated with the order.

We may use third-party payment processors, fraud-prevention services, and verification providers to process and review transactions.

Section 5 — Shipping and Delivery

Processing times, available shipping methods, tracking, carrier delays, address corrections, missing packages, damaged shipments, and other delivery-related matters are governed by our Shipping Policy.

Shipping options and rates are calculated during checkout based on the products ordered, package details, delivery address, and available carrier services.

All processing and delivery dates are estimates and are not guaranteed. Carrier delays, severe weather, holidays, transportation disruptions, incorrect addresses, safety restrictions, and other circumstances outside our reasonable control may affect delivery.

Orders containing power banks, standalone lithium batteries, or other regulated products may be restricted to eligible ground transportation.

We will provide reasonable assistance with appropriate carrier inquiries or claims as described in our Shipping Policy. Ownership and risk of loss will pass in accordance with applicable law.

Section 6 — Intellectual Property

The Services and their contents—including text, graphics, logos, photographs, videos, product descriptions, designs, software, reviews, page layouts, and other materials—are owned by or licensed to The Deal Station and are protected by applicable intellectual-property laws.

You may use the Services only for lawful personal and noncommercial purposes.

Without our prior written authorization, you may not:

  • Reproduce or distribute our content
  • Modify or create derivative works from our content
  • Republish or commercially exploit our content
  • Remove copyright, trademark, or ownership notices
  • Use our product photographs or descriptions in another commercial listing
  • Use our trademarks, business name, logos, or branding in a misleading manner

Nothing in these Terms grants you ownership of or a license to The Deal Station’s intellectual property except for the limited right to use the Services in accordance with these Terms.

The Shopify name, logos, products, and related marks belong to Shopify or its licensors. Other names and marks displayed through the Services belong to their respective owners.

Section 7 — Optional and Third-Party Tools

We may provide access to tools, integrations, payment options, tracking services, applications, or other features supplied by third parties.

Third-party tools may be provided “as is” and “as available.” We do not control and are not responsible for their independent operation, availability, policies, or security practices.

Your use of third-party tools is at your discretion and may be subject to separate terms and privacy policies.

New tools, features, and resources that we add to the Services will also be subject to these Terms unless separate terms are provided.

Section 8 — Third-Party Links

The Services may contain links to websites, products, applications, or services operated by third parties.

We are not responsible for evaluating or guaranteeing third-party content, accuracy, security, products, services, or policies.

Accessing a third-party website is at your own risk. Review the third party’s terms, policies, and practices before providing information or completing a transaction.

Questions or complaints regarding a third-party product or service should generally be directed to that third party.

Section 9 — Relationship With Shopify

The Deal Station is powered by Shopify, which provides the ecommerce platform used to offer the Services.

Purchases made through our store are transactions directly between you and The Deal Station. Shopify is not the seller of the products offered by The Deal Station and is not responsible for product descriptions, customer service, fulfillment, returns, refunds, injuries, damages, or losses arising from products purchased from us, except to the extent otherwise required by applicable law or expressly provided through a Shopify service.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising solely from transactions between you and The Deal Station.

Section 10 — Privacy

Personal information collected through the Services is handled as described in our Privacy Policy.

Because Shopify hosts and supports the Services, Shopify and approved service providers may collect and process information relating to your access to and use of the Services.

Information may also be shared with payment processors, shipping providers, fraud-prevention services, analytics providers, communication providers, and other parties needed to operate the store and fulfill transactions.

Section 11 — Reviews, Feedback, and Submissions

When you submit a review, photograph, video, suggestion, comment, or other content to us, collectively referred to as “Feedback,” you represent that you have the right to provide it.

You grant us a nonexclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display the Feedback for purposes including operating, improving, and promoting the Services.

You represent that your Feedback:

  • Is accurate to the best of your knowledge
  • Does not violate another person’s intellectual-property or privacy rights
  • Does not contain unlawful, defamatory, abusive, obscene, or misleading material
  • Does not contain malicious code
  • Discloses any material compensation or incentive related to the submission when required

We may monitor, reject, edit, or remove Feedback that we reasonably believe violates these Terms or applicable law.

We are not obligated to maintain Feedback in confidence, compensate you for Feedback, or respond to Feedback.

Section 12 — Errors, Inaccuracies, and Omissions

The Services may occasionally contain typographical errors, inaccurate information, or omissions relating to product descriptions, specifications, prices, promotions, availability, shipping charges, or delivery estimates.

We may correct errors, update information, or cancel affected orders when reasonably necessary, including after an order has been submitted.

When an order is affected by a material error, we will attempt to contact you using the information provided with the order.

Section 13 — Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services to:

  • Violate any applicable law, regulation, or ordinance
  • Infringe intellectual-property, privacy, publicity, or other legal rights
  • Harass, threaten, abuse, defame, or harm another person
  • Submit false, deceptive, or misleading information
  • Commit fraud or use an unauthorized payment method
  • Upload malware, viruses, or harmful code
  • Send spam, phishing messages, or unauthorized solicitations
  • Collect personal information about others without authorization
  • Impersonate another person or entity
  • Interfere with the security or normal operation of the Services
  • Bypass access controls, rate limits, CAPTCHAs, or security measures
  • Scrape, extract, reproduce, or commercially exploit store content without authorization
  • Use automated tools in a manner that disrupts the Services or violates these Terms

We may suspend or terminate access when we reasonably determine that these restrictions have been violated.

Section 14 — Automated Agents

This section applies when automated or semi-automated software, services, bots, or artificial-intelligence systems, referred to as “Agents,” access or interact with the Services.

An Agent must not access or interact with the Services when we have requested that it stop or when access is blocked by technical controls.

Agents must:

  • Accurately identify themselves when technically required
  • Not disguise automated activity as human activity
  • Not bypass CAPTCHAs, rate limits, access controls, or other security measures
  • Respond truthfully when asked whether an interaction is automated
  • Comply with applicable technical instructions and access restrictions

We may limit or block automated access to protect the Services, customers, and store operations.

Section 15 — Termination

We may suspend, restrict, or terminate your access to the Services when reasonably necessary to enforce these Terms, comply with law, prevent fraud or abuse, or protect customers and the Services.

You remain responsible for amounts properly owed for transactions completed before termination.

Provisions that by their nature should survive termination—including intellectual property, feedback licenses, warranty disclaimers, limitations of liability, indemnification, governing law, and privacy provisions—will remain effective.

Section 16 — Disclaimer of Warranties

Information provided through the Services is made available for general informational purposes.

To the fullest extent permitted by applicable law, the Services and products offered through them are provided “as is” and “as available,” except for any express warranty, written product guarantee, or legal right that cannot be excluded.

We do not guarantee that:

  • The Services will always be uninterrupted, secure, or error-free
  • Product information will never contain an error
  • Every product will meet every customer’s subjective expectations
  • Every feature will work with every device, application, accessory, or operating system

Some jurisdictions do not permit the exclusion of certain warranties. In those jurisdictions, these exclusions apply only to the extent permitted by law.

Nothing in these Terms limits rights that cannot lawfully be waived or excluded.

Section 17 — Limitation of Liability

To the fullest extent permitted by law, The Deal Station and its owners, affiliates, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services or products purchased through them.

This may include loss of profits, revenue, data, savings, opportunity, or replacement costs.

Where applicable law does not allow a particular limitation or exclusion, that limitation will apply only to the maximum extent permitted.

Nothing in these Terms excludes or limits liability for conduct or damages that cannot legally be excluded or limited.

Section 18 — Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless The Deal Station, Shopify, and their respective affiliates, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, or reasonable legal expenses arising from:

  • Your material violation of these Terms
  • Your unlawful use of the Services
  • Your infringement of another party’s rights
  • Content or Feedback you submit
  • Fraudulent or unauthorized conduct associated with your account

We will provide reasonable notice of an indemnifiable claim when practicable. You agree to reasonably cooperate in the defense of such a claim.

Section 19 — Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted or severed from these Terms.

The remaining provisions will continue in effect.

Section 20 — Waiver and Entire Agreement

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and other policies or rules posted through the Services, constitute the entire agreement between you and The Deal Station regarding use of the Services.

They supersede prior communications or agreements concerning the same subject matter.

Section 21 — Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights or obligations in connection with a sale, reorganization, transfer of the business, change in service provider, or as otherwise permitted by law.

Section 22 — Governing Law

These Terms and any separate agreements through which we provide the Services are governed by the laws of the State of Michigan and applicable federal law, without regard to conflict-of-law principles.

Subject to applicable consumer-protection laws and any rights that cannot be waived, you and The Deal Station consent to the jurisdiction of the appropriate state or federal courts located in Michigan.

Section headings are included for convenience and do not limit or otherwise affect the interpretation of these Terms.

Section 24 — Changes to These Terms

The current version of these Terms will be posted on this page.

We may update these Terms to reflect changes to our Services, policies, business practices, legal obligations, or other operational needs.

Material changes will become effective on the date stated in the updated Terms or as otherwise required by law.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms, except where applicable law requires additional notice or consent.
